Eviction (March 2025)
Mr M was unhappy about our handling of their eviction and the removal of their belongings.
Summary
The former resident complained about our handling of:
- the resident’s eviction
- the removal of the resident’s belongings
The Ombudsman confirmed that it cannot consider complaints about matters already decided by the courts, in line with paragraph 41.c. of the Housing Ombudsman Scheme. The eviction order was made in November 2022, and therefore, the Ombudsman cannot address the complaint regarding the eviction itself.
The complaint about the disposal of the resident’s belongings is also outside the Ombudsman’s jurisdiction, as it is a consequence of the court’s decision. According to paragraph 42.f., this issue would be more appropriately resolved through the courts.
Outcome
The Ombudsman determined that the case was not within its jurisdiction.
